Mr. Phillips focuses his practice on bankruptcy and corporate reorganization as well as the representation of companies in civil litigation and complex commercial litigation. He has more than two decades of experience representing a wide variety of clients in large and complex Chapter 11 and Chapter 7 corporate bankruptcy proceedings, including unsecured creditors, lenders, landlords, equipment lessors, trade creditors, directors and officers, intellectual property licensors and licensees, insurance carriers, municipal taxing authorities, utilities, asset purchasers, bondholders, note holders, trustees and committees. He also represents defendants in bankruptcy preference and fraudulent transfer litigation and directors and officers in breach of fiduciary duty litigation.
 
Mr. Phillips is a certified mediator for the United States Bankruptcy Court for the District of Delaware and listed on the Court’s Register of Mediators and Arbitrators.

Prior to his legal career, he played professional baseball within the Kansas City Royals organization for several years.

  • Represented junior secured noteholders in the United States Bankruptcy Court for the District of Delaware resulting in a favorable settlement for the clients
  • Represented large trade creditor in firearms bankruptcy cases in the United States Bankruptcy Court for the District of Delaware to ensure one hundred percent recovery from bankruptcy estates
  • Represented landlords of shopping centers in multiple bankruptcy cases in the United States Bankruptcy Court for the District of Delaware to ensure compliance with going out of business sales procedures, payment of cure amounts with respect to assumption of lease and damages with respect to rejection of leases
  • Represented directors and officers in multiple adversary proceedings in the United States Bankruptcy Court for the District of Delaware against breach of fiduciary duty claims and obtained favorable settlements
  • Represented electric utility provider in multiple bankruptcy cases in the United States Bankruptcy Court for the District of Delaware to ensure favorable adequate assurance terms pursuant to 11 U.S.C. § 366
  • Represented mechanics lien holders in multiple bankruptcy cases in the United States Bankruptcy Court for the District of Delaware and obtained substantial recoveries for the clients
